Sex amendment on an Alberta birth record

Disclaimer: The Government of Alberta cannot guarantee that a birth certificate with the non-binary marker “X” will be accepted by authorities in other organizations.

A person’s sex indicator on their Alberta birth record may be amended to M, F or X. 

Amending own birth record

The following are required to amend the sex indicator on a person’s own Alberta birth record. 

  • The person must be born in Alberta.
  • The person must be 
    • 18 years of age or older, or 
    • younger than 18 years of age and one of the following: 
      • married, 
      • divorced,  
      • widowed,
      • in an adult interdependent relationship, 
      • the parent of a child, or 
      • the guardian of another person 
  • An Affidavit: Sex Amendment for an Adult must be completed and signed by the person whose sex indicator is being amended. 
    • The affidavit must be executed by a Commissioner for Oaths or a Notary Public. 
  • All Alberta birth certificates issued before the amendment must be returned to Vital Statistics. 
    • Returned birth certificates will be cancelled and replaced free of charge with new birth certificates reflecting the amended sex indicator.
  • The government amendment fee is $20.
    • The amendment fee may be paid by cheque or money order made out to the Government of Alberta. Do not send cash through the mail.
    • The fee can be waived on a case-by-case basis if it poses a financial barrier. After an amendment request is made through a registry agent or through Vital Statistics, applicants can request that the Registrar waive the $20 government fee. 

Send the affidavit, birth certificates and fee to Vital Statistics for processing.

 

Amending birth record of a minor (age 12 to 17)

The following are required to amend the sex indicator on a minor’s Alberta birth record (age 12 to 17).

  • The minor must be born in Alberta. 
  • The minor must be 12 to 17 years of age. 
  • A parent or guardian must apply to amend the Alberta birth record of their child or ward. 
    • An Affidavit: Sex Amendment for a Minor must be completed and signed by a parent or guardian.
    • The affidavit must be executed by a Commissioner for Oaths or a Notary Public.  
    • When the applicant is a guardian, a copy of the guardianship order is required. 
  • All parents and guardians of the minor must consent to amending the minor’s sex indicator. 
    • All parents and guardians must each complete and sign a Consent to Amend form. 
    • Their consent must be witnessed. 
    • When a guardian’s consent is being provided, a copy of their guardianship order is required. 
  • The minor (age 12 to 17) must consent to the amendment of their sex indicator. 
    • The minor must complete and sign a Consent to Amend form. 
    • The minor’s consent must be witnessed. 
  • All Alberta birth certificates issued before the amendment must be returned to Vital Statistics. 
    • The birth certificates will be cancelled and replaced free of charge with new birth certificates reflecting the amended sex indicator.
  • The government amendment fee is $20.

Amending birth record of a minor (age 11 or younger)

The following are required to amend the sex indicator on a minor’s Alberta birth record (11 or younger). 

  • The minor must be born in Alberta. 
  • The minor must be 11 years of age or younger. 
  • A parent or guardian must apply to amend the Alberta birth record of their child or ward. 
    • An Affidavit: Sex Amendment for a Minor must be completed and signed by a parent or guardian.
    • The affidavit must be executed by a Commissioner for Oaths or a Notary Public.  
    • When the applicant is a guardian, a copy of the guardianship order is required.  
  • All parents and guardians of the minor must consent to amending the minor’s sex indicator. 
    • All parents and guardians must each complete and sign a Consent to Amend form. 
    • Their consent must be witnessed. 
    • When a guardian’s consent is being provided, a copy of their guardianship order is required. 
  • A statement from a professional who holds a valid practice permit is required. 
    • Have the professional complete the prepared Professional Statement for a Minor Under 12 form. 
    • A professional must be one of the following: 
      • A regulated member of the College of Physicians and Surgeons of Alberta 
      • A regulated member of the College of Alberta Psychologists
      • A regulated member of the College and Association of Registered Nurses of Alberta 
      • A regulated member of the Alberta College of Social Workers 
    • When the professional is from another jurisdiction, the person must be of a practicing profession equivalent to that as above in Alberta. 
  • All Alberta birth certificates issued before the amendment must be returned to Vital Statistics. 
    • The birth certificates will be cancelled and replaced free of charge with new birth certificates reflecting the amended sex indicator. 
  • The government amendment fee is $20.
